Internal Complaint Committee: 'Sexual Harassment at Workplace Act, 2013'
The Internal Complaint Committee (ICC) in the Vidya Pratishthan’s Kamalnayan Bajaj Institute of Engineering and Technology, VPKBIET is constituted in the year 2017 according to ‘The Sexual Harassment at Workplace (Prevention, Prohibition and Redressal) Act, 2013’. Along with this Act, the ICC seeks to follow the Vishakha guidelines (1997) preceding of this legislation in order to address the issues of sexual harassment at workplace for establishing gender equality. The ICC aims to look into the complaints of sexual harassment in the institution and also to generate awareness about the issue. The Act has outlined the constitution of the committees, the process to be followed for making a complaint and conducting inquiry into the complaint in a time bound manner.
What is Sexual Harassment?
An act of sexual harassment includes any one or more of the unwanted acts or behaviour, whether directly or by implication:
i. Physical contact and advances; or
ii. A demand or request for sexual favours; or
iii. Making sexual coloured remarks; or
iv. Showing pornography; or
v. Any unwelcome physical, verbal or non-verbal conduct of sexual nature.
The following circumstances, among other circumstances, if it occur or are present in relation to or connected with any act or behaviour of sexual harassment, may also add up to sexual harassment;
i. Implied or explicit promise of preferential treatment in her employment; or
ii. Implied or explicit threat of detrimental treatment in her employment; or
iii. Implied or explicit threat about her present or future employment status; or
iv. Interference with her work or creating and intimidating or offensive or hostile work environment for her; or
v. Humiliating treatment likely to affect her health or safety.

Functioning of ICC
Objectives of the Committee
The Internal Complaint Committee is an educational resource as well as a complaint redressal mechanism for the members of faculty, staff and students of the VPKBIET. Its mandates are:
To provide a impartial, confidential and supportive environment for members of the campus community who may have been sexually harassed
To advice complainants the means of resolution as specified by the legislation
To ensure just and timely resolution of sexual harassment complaints
To provide counselling and support services in the campus
To promote awareness about sexual harassment through educational initiatives that encourages and nurtures a respectful and safe campus environment.
The committee seeks to inform the campus community of their right to a respectful work and learning environment. It believes that if we practice respecting each other, exercise empathy in our interactions andif we do not hurt anyone through what we say or do, then, we can create a campus that is free of sexual harassment.
The Committee aims to achieve these goals through:
Complaint Redressal: As per the act ‘The Sexual Harassment at Workplace (Prevention, Prohibition and Redressal) Act, 2013’, appropriate action will be taken once the complaint is filed.
Spreading of Information: by providing materials on website, posters, banners and handouts etc. to the VPKBIET campus community.
Awareness Workshops: for faculty, non-teaching staff and students with an aim to develop safe and comfortable atmosphere of mutual learning.
Counselling – Confidential counselling service is an important service as the sexual harassment cases are rarely reported and is a sensitive issue. Counselling provides a safe space to speak about the incident and how it has affected the aggrieved woman.
Who can file the Complaint to the Internal Complaint Committee?
Any student, teaching or non-teaching staff may lodge a complaint against a student, teaching or non-teaching staff.
About Inquiry process
The Internal Complaints Committee shall make enquiry into the complaint in accordance with the provisions of the Service Rules applicable to the respondent. For the purpose of the enquiry, if the respondent is a non-teaching employee or teacher of VPKBIET, provisions of Rules and Teachers' Acts as per SPPU are applicable. If the Respondent is a student, an enquiry shall be made as per provisions of Ordinance 157 as regards maintenance of discipline and good conduct by students.

Complaint Registering Procedure
Any aggrieved woman can file complaint in writingin paper or by sending an e-mail, to the ICC, within a period 3 months from the date of incident (sexual harassment at work place).
As per the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules, 2013, in case the aggrieved womanis unable to make a complaint in writing or on account of her physical incapacity, the ICC will provide all possible assistance to her for making the complaint in writing or through her relative or friend or her co-workeror any person who has knowledge of the incident, with the written consent of the aggrieved woman.
If the ICC is satisfied that the circumstances were such, which prevented the woman from filing a complaint within a period of 3 months, it may extend the time limit not exceeding three months.
The complainant needs to submit six copies of the complaint along with the supporting documents and names and addresses of the witnesses to the ICC. On receipt of the complaint, the Committee will send one of the copies to the respondent within a period of seven working days and ask the respondent to file his reply to the complaint along with his list of documents and names and addresses of witnesses, within a period not exceeding ten working days from the date of receipt of the complaint by him. Legal practitioner is not allowed to represent the case at any stage of the proceedings before the Committee.
Activities Conducted
An Online programme on "Importance of Values in Professional Education and Awareness on Women Harassment Act 2013" was conducted on the 4th day of FE Induction Programme -2021 on 5th February 2021. The speaker of this session was Prof. Vivek Bansode of VP's Vasantrao Pawar Law College, Baramati. About 357 students have attended this session online.

'Maharashtra state commission for Woman' and 'Savitribai Phule
Pune University', VPKBIET Baramati have arranged awareness workshop
on 27 Feb. 2017. 250 girls had participated for the workshop.
The invited resource persons are as follows:
1. Mrs. Madhuri Mahendra Bade, Judicial Magistrate First class and civil judge , Junior division, Baramati
2. Mrs. Ashwini Jotiram Bachulkar, Civil Judge Junior Division and Judicial Magistrate First class.
Nirbhaya Abhiyan Conducted on 29/2/2020 at VPASC College, Baramati. From VPKBIET a total of 57 girls participated in this event.
This activity was conducted to build the confidence and personality of girl students who come from the rural areas and are deprived sections of society. The girl students were given training in health, law, and social activities.
International Women's Day was celebrated on 8/3/2020 by all the women staff of VPKBIET. Lunch was organized by the committee to all the women staff.
Haemoglobin count camp was conducted for girl students and women staff of VPKBIET at VPKBIET workshop, Baramati, on 29th and 30th March 2019. A total of 639 ladies including girl students underwent the test during the camp. A team from Indian Medical Association (IMA), Baramati visited the college for conducting this camp. This activity was arranged for health awareness for ladies.
